User Agreement

This User Agreement ("Agreement") is entered into between you ("User") and the CaptionFlow operator ("we", "us", or "our") regarding your use of the CaptionFlow application and related services ("Services"). This Agreement, together with our Terms of Service and Privacy Policy, forms the complete legal framework governing your use of the Services.

This Agreement applies to all your activities accessing and using CaptionFlow Services on any platform, including but not limited to Android and Windows.

We reserve the right to revise this Agreement at any time due to changes in laws, product updates, or other reasons. Revised terms will be announced in the app or through official channels and become effective upon publication. Continued use of the Services constitutes acceptance of the revised Agreement.

2.1 Registration Eligibility

To use the Services, you must:

• Be at least 18 years old, or use the Services with the consent and supervision of a parent or guardian
• Have full legal capacity
• Provide true, accurate, and complete registration information
• Not have been permanently banned for prior violations

2.2 Account Responsibility

Your account is for your personal use only. You are fully responsible for all activities that occur under your account. You may not share, transfer, or sell your account. Notify us immediately upon discovering any unauthorized account activity.

2.3 Identity Verification

Certain advanced features may require identity verification. Information provided for verification must be authentic and valid. You bear full responsibility for any consequences arising from providing false information.

3.1 Usage License

Subject to your compliance with this Agreement, we grant you a personal, non-exclusive, non-transferable, limited license to install and use the CaptionFlow application on your device solely for your personal use.

3.2 License Restrictions

You may not:

• Copy, modify, distribute, sell, or rent the application
• Reverse engineer, decompile, or disassemble the application
• Remove or alter any copyright notices or identifiers in the application
• Use the application for any commercial purpose (unless expressly authorized in writing)
• Create derivative works based on the Services

3.3 Local AI Models

Local AI models built into CaptionFlow (including LLaMA-based speech recognition models) are subject to their respective open-source licenses. You must comply with the original license agreements for these models during use.

4.1 Content Ownership

You retain original ownership of audio content processed through the Services and the translation records generated. You grant us a limited license necessary to provide and improve the Services.

4.2 Code of Conduct

You agree not to use the Services to:

• Record, translate, or distribute others' private conversations without their consent
• Infringe upon others' privacy, copyright, or other legal rights
• Generate or distribute illegal, harmful, or discriminatory content
• Engage in any fraudulent, harassing, or illegal activities
• Circumvent or interfere with the security mechanisms of the Services

4.3 Content Moderation

We do not proactively review user translation content, but reserve the right to take necessary action upon receiving valid compliance complaints, including removing content or restricting account features.

5.1 Free Features

CaptionFlow provides basic free features, including a limited number of speech recognitions and translations. Free feature usage limits may be adjusted at any time with advance notice.

5.2 Paid Subscriptions

Advanced features require a paid subscription. Subscription prices are as displayed in the app, with monthly and annual billing options. Subscription fees are automatically charged to your payment method at the start of each billing period.

5.3 Cancellation & Refunds

• You may cancel auto-renewal at any time in your account settings; you retain access for the remainder of the current billing period
• Fees paid are non-refundable except where required by law
• If a serious service failure prevents use, contact support to request a refund evaluation

5.4 Price Changes

We reserve the right to modify pricing. Price changes will be notified 30 days in advance, and you may cancel your subscription during the notice period.

Your privacy is of utmost importance to us. Our collection, use, and protection of your personal data is governed by our Privacy Policy. Please review it for details.

Key Data Commitments

• Audio data is processed in real time and immediately destroyed — raw recordings are never stored
• In local AI mode, all processing occurs on your device; data never leaves your device
• During cloud processing, transmitted content is encrypted and deleted immediately after processing
• Your translation history is stored only on your device and can be deleted at any time
• We will never sell your personal data

All intellectual property rights in the CaptionFlow application, interface design, algorithms, trademarks, and related documentation belong to us and are protected by copyright, trademark, and other intellectual property laws.

The usage license granted under this Agreement does not include any transfer of ownership of the above intellectual property. Use of the Services confers no intellectual property rights on you.

8.1 Services Provided "As Is"

The Services are provided "as is" and "as available" without any express or implied warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

8.2 Translation Accuracy

AI translation results are for reference only and do not constitute professional translation advice. In medical, legal, safety, or other professional contexts, do not rely solely on the Services' translation output.

8.3 Limitation of Liability

To the maximum extent permitted by law, we are not liable for any direct, indirect, incidental, special, punitive, or consequential damages arising from your use of the Services, even if we have been advised of the possibility of such damages.

9.1 User-Initiated Termination

You may terminate this Agreement at any time by deleting your account. After deletion, your account data will be deleted upon expiry of the legally required retention period.

9.2 Our Right to Terminate

We may immediately terminate or suspend your access to the Services if:

• You breach any provision of this Agreement
• Your conduct may cause harm to us, other users, or third parties
• Required by applicable laws or regulations
• We decide to discontinue the Services

9.3 Effect of Termination

Upon termination, provisions relating to intellectual property, disclaimers, limitation of liability, and dispute resolution shall survive.

This Agreement shall be governed by and construed in accordance with applicable laws. Any dispute arising from this Agreement shall first be resolved through good-faith negotiation. If negotiation fails, either party may submit the dispute to a court of competent jurisdiction.

If any provision of this Agreement is found invalid or unenforceable, that provision shall be enforced to the maximum extent permissible, and the remaining provisions shall continue in full force and effect.
